What is an H-1B?

The H-1B is a nonimmigrant classification used by an alien who will be employed temporarily in a specialty occupation or as a fashion model of distinguished merit and ability.

What is a specialty occupation?

A specialty occupation requires theoretical and practical application of a body of specialized knowledge along with at least a bachelor’s degree or its equivalent. For example, architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts are specialty occupations.

Is there an annual limit on the number of H-1B aliens?

Yes. The current law limits to 65,000 the number of aliens who may be issued a visa or otherwise provided H-1B status in each Fiscal Year. (The numerical limitation was temporarily raised to 195,000 in FY2001, FY2002 and FY2003.)

How does one apply?

H-1B status requires a sponsoring U.S. employer. The employer must file a labor condition application (LCA) with the Department of Labor attesting to several items, including payment of prevailing wages for the position, and the working conditions offered. The employer must then file the certified LCA with a Form I-129 petition plus accompanying fee of $185. Additional fee of $1,500 for emplyers with 25 + employees or $750.00fee for employers with less than 25 employees; amd $500.00 of H-1B Fruad Prevention fee.  Certain sponsors are exempted for some fee.  Based on the USCIS petition approval, the alien may apply for the H-1B visa, admission, or a change of nonimmigrant status.

How long can an alien be in H-1B status?Under current law, an alien can be in H-1B status for a maximum period of six years at a time. After that time an alien must remain outside the United States for one year before another H-1B petition can be approved. Certain aliens working on Defense Department projects may remain in H-1B status for 10 years. In addition, certain aliens may obtain an extension of H-1B status beyond the 6-year maximum period, when:

 

  1. 365 days or more have passed since the filing of any application for labor certification, Form ETA 750, that is required or used by the alien to obtain status as an EB immigrant, or
  2. 365 days or more have passed since the filing of an EB immigrant petition.

Who can an H-1B alien work for?

H-1B aliens may only work for the petitioning U.S. employer and only in the H-1B activities described in the petition. The petitioning U.S. employer may place the H-1B worker on the worksite of another employer if all applicable rules (e.g., Department of Labor rules) are followed. H-1B aliens may work for more than one U.S. employer, but must have a Form I-129 petition approved by each employer.

What if the alien’s circumstances change?

As long as the alien continues to provide H-1B services for a U.S. employer, most changes will not mean that an alien is out of status. An alien may change H-1B employers without affecting status, but the new H-1B employer must file a new Form I-129 petition for the alien before he or she begins working for the new employer. The merger or sale of an H-1B employer’s business will not affect the alien’s status in many instances. However, if the change means that the alien is working in a capacity other than the specialty occupation for which they petitioned, it is a status violation.

Must an H-1B alien be working at all times?

As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

Can an H-1B alien travel outside the U.S.?

Yes. An H-1B visa allows an alien holding that status to reenter the U.S. during the validity period of the visa and approved petition.

Can an H-1B alien intend to immigrate permanently to the U.S.?

Yes. An H-1B alien can be the beneficiary of an immigrant visa petition, apply for adjustment of status, or take other steps toward Lawful Permanent Resident status without affecting H-1B status. This is known as “dual intent” and has been recognized in the immigration law since passage of the Immigration Act of 1990. During the time that the application for LPR status is pending, an alien may travel on his or her H-1B visa rather than obtaining advance parole or requesting other advance permission from Immigration to return to the U.S.

Can an H-1B visa holder bring their spouse and minor children to U.S.?

Yes.  H-1B holders can bring thier spouse and minor children to live with them in U.S. under H dependents visa (H-4).  However, H-4 visa holders can not work in U.S.  Spouse here on an H-4 visa must have his or her own H-1B visa to work legally in U.S.

What is a J-1 visa?
The J-1 visa is designated for Exchange Visitors which allows people to come to the
United States for short durations to engage in educational and cultural exchange activities. A J-1 visa holder must have an “visa stamp” in the foreign national’s passport which allows him or her to enter the
U.S. in J-1 status. 

 What is the J-1 Exchange Visitor Program?
The Mutual Educational and Cultural Exchange Act of 1961, promotes mutual understanding between the people of the
U. S. and other countries by means of educational and cultural exchange. The Exchange Visitor Program, administered by the Department of State, implements this Act by providing foreign nationals with opportunities to participate in exchange programs in the United States and then return home to share their experiences.

 What is form DS-2019?
The DS-2019 (formerly known as IAP-66) is the Department of State form that governs an individual’s J-1 program. The DS-2019 is issued by a Responsible Officer or Alternate Responsible Officer of the College or University as designated by the Department of State. The foreign national must additionally obtain “J-1 status” by entering the

U.S. on a J-1 visa or obtaining an approved change of status from the Bureau of Citizenship and Immigration Services.

If you have a potential sponsor, how do know if you are a good candidate for the J-1 Program?
You are probably a good fit for the J-1 program of the following apply to you.

  1. The position is a temporary training position such as a Postdoctoral Fellowship or a Project Appointment.
  2. The foreign applicant intends to return home at the end of this program.
  3. The program fit into one of the categories listed below
    1. Research Scholar or Professor: A person who is engaging in a program for the purpose of conducting advanced research, teaching, lecturing, observing or consulting. To qualify an individual must have a minimum of a Bachelor’s degree and extensive experience in the relevant field and have not been in the
      U.S. in any “J” category for more than 6 months of the 12 months proceeding the requested. (Min. length of stay = 3 weeks, Max. length of stay = 36 months)
    2. Short-term Scholar: A person who is engaging in a program to lecture, observe, consult, participate in seminars, workshops, conferences, study tours, professional meetings or similar types of education and professional activities. Same qualifications apply as the Research Scholar category. (Min. length of stay = none, Max. length of stay = 6 months)
    3. Specialist: A person who is an expert in a field of specialized knowledge or skills, who is visiting the United States for the purpose of observing, consulting, or demonstrating his/her special skills. (Min. length of stay = 3 weeks, Max. length of stay = 12 months)
    4. Student: A person who is enrolled at a post-secondary accredited educational institution in the
      United States for the purpose of study. (Length of stay = as long as the individual is enrolled full-time at the Medical
      College and pursuing a degree)  

What is the process to bring someone to the
U.S. on a non-clinical J-1?

  1. The department should complete a J-1 Application and forward it with the exchange visitor’s resume/curriculum vitae and funding documentation to the MCW Employment Office.
  2. The International Scholar Coordinator (ISC) or other authorized Employment Office member will issue a DS-2019 form and contact the department to pick the form up.
  3. The department forwards the form to the exchange visitor.
  4. The exchange visitor takes the DS-2019 to his/her local consulate and applies for a J-1 entry visa.
  5. The exchange visitor should present both the DS-2019 and the J-1 entry visa upon entry to the
    U.S.

Who runs the J-1 Exchange Visitor Program?
The J-1 program is run by the Department of State. However, much of the program literature still refers to the United States Information Agency (USIA) who previously held responsibility for the program. The USIA was dissolved in October of 2000 and the functional office was absorbed into the Department of State.

How long can someone stay in J-1 status?
Maximum duration is dependent upon the “category” an exchange visitor is in.
Here are some examples for some of the Colleges who are authorized to issue non-clinical J-1s in the following categories:

What is the One Year Bar?
The one year bar states that you are not eligible to begin a J-1 program in the Research Scholar/Professor category if you have been in the

U.S. in the last 12 months for more than 6 months. Note that this is not the same as the 2-year home residency requirement. The one year bar only applies to individuals looking to start a J-1 program in the Research Scholar/Professor category.
 

What is the 2-year Home Residency Requirement (or Section 212(e))?
Many J-1 exchange visitors are subject to a 2-year Home Residency Requirement. Individuals subject to this cannot apply for change of status, obtain an H visa, or obtain permanent residency until they have spent 2-years in their home country.

Who is subject to the 2-year Home Residency Requirement?
 The foreign residency requirement applies to you if:
1. Your program was financed by your government; or
2. Your program was financed by the

U.S. government; or
3. Your country has been designated by the USIA as requiring your particular skills.

If the requirement does apply to you then you must:
1. Return to your country of nationality or last residence;
2. Reside there for two years.

Only when these requirements have been satisfied may you apply for a temporary worker visa (such as H-1, TN) or permanent residence (Greencard).

The only way to avoid the foreign residence requirement is by obtaining a waiver.

You May Be Eligible for a Waiver If:
1. Departure form the U.S. would impose exceptional hardship upon your spouse or child;
2. Return to the country of nationality/last residence would subject you to persecution;
3. Your admission to the U.S. is in the public interest according to the Attorney General; or
4. A no-objection statement from the home country (FMGs subject to additional requirements).

Can dependents of a J-1 work?
Yes, individuals in J-2 status can work if they obtain an Employment Authorization Card.

Can you get paid on a J-1?
Yes, if you are on a J-1 sponsored by a College and you are getting paid for work done as part of the exchange visitor program.

Can someone continue working once their DS-2019 has expired?
Only if some other form of work authorization has been obtained.

hi im ernesto dela cruz, my father has petitioned me together with my 3 brothers. We have the same priority dates but they have already left. and i am still here in my country. we have already interviewed and been examined. All we are waiting is for our visa to be delivered. Unfortunately during our interview, there are some documents that been asked from me. our interview was july 26, 2006, i have given the said document in first week of august already. It is said that we have been included in the cut off visa priority dates. our priority date is june 29, 1988 and in the visa bulletin the cut off priority date are those earlier than june 1, 1990 does our priority date is now on process??? how much time does we need to wait for our visa to released by the visa center? does it will take years? please respond.

MY SISTER CAME TO AMERICA, SHE GOT A STAMP IN HER PASSPORT THAT ENTITLED HER TO REMAIN IN THE COUNTRY FOR SIX MONTHS, WITH THE FUSTRATION OF BEING A TEENAGE PARENT AND NEGLETED BY HER BOYFRIEND WHO WAS THERE AT THE TIME, SHE DECIDED TO HAVE HER BABY THERE AND APPLIED F0R AN EXTENTION OF HER VISA, EVERYTHING WAS GOING FINE, SHE SUBMITTED ALL THE DOCUMENTS AND WAS CONSTANTLY IN TOUCH WAITING FOR A RESPONSE FROM THE IMMIGRATION DEPT. THEY TOLD HER THAT ONCE HER APPLICATION WAS ON FILE SHE WAS LEGAL TO REMAIN UNTIL ANSWERED, SO SHE DID JUST THAT. NOT HAVING ANYONE TO SEEK ADVISE FROM SHE JUST WENT ALONG WITH WHAT THEY SAID. THEY TOOK QUITE A WHILE BEFORE THEY RESPONDED ACTUALLY ABOUT ONE YEAR OR MORE. SHE WAS DENIED THE EXTENTION ON GROUNDS THAT SHE DID NOT PROVE TO HAVE ENOUGH SUPPORT, SO WITH THAT SHE CAME BACK ON THE RETURN TICKET SHE HAD BOUGHT TO PROVE THAT SHE WOULD RETURN TO THE COUNTRY , WHICH WAS ABOUT FIVE WEEKS THEREAFTER, SHE LATER WENT TO REAPPLY FOR A VISA AND WAS DENIED, SINCE THEN SHE IS PERMANENTLY EMPLOYED WITH THE ELECTRICITY COMPANY ON HER ISLAND POSESES 1/4 ACRE OF LAND, HAS INTERNATIONAL HEALTH INSURANCE THROUGH HER JOB AND MUCH MORE, SHE WOULD ONLY LIKE TO VISIT AMERICA WITH HER SON SO HE WOULD HAVE MEMORIES OF WHERE HIS FIRST MOMENTS OF LIFE WAS. I would like to aske that if a pakistani family born a baby in uk. They are legaly husband and wife and have three kids with them. The have applied asylam eight months ago and finacial help and legal aid has been granted in there favour but there two appeals have been declined and third one is under considration in the court of law. Either their new baby will be the national of uk or not.
